The "MySalesIQ" app (hereinafter "App") is provided by Philips Domestic Appliances Australia, 65 Epping Road, North Ryde, 2113, Sydney, NSW (hereinafter "we" or "us"). When using the app, we process personal data. With the following information we would like to inform you which of your personal data is processed by us and how.
Philips Domestic Appliances Australia is part of a multinational group of companies with Head Office in Amsterdam, Netherlands, Europe. Therefore, we apply European data protection law/s (GDPR) principles globally. Of course, we also verify applicability of local laws.
Please note that this data protection declaration only describes the processing of your personal data that takes place within the scope of this app and the functions associated with it, such as e.g. is described in the "Terms of Use for the "MySalesIQ" app of Philips Domestic Appliances Australia. The processing of your personal data to provide the Philips business activities that can be used via the app is based on our general data protection information.

If you use the app to access third-party websites or use other services and personal data is processed outside of this app as a result, you should consult the data protection declarations of the websites or the other services.

2 Subject of data protection
The subject of data protection is personal data. According to Art. 4 No. 1 of the General Data Protection Regulation (GDPR), this is all information relating to an identified or identifiable natural person. This includes e.g. B. Inventory data such as the authorization data for certification in the app and the management of a points account in the MySalesIQ app. Usage data such as the date and time of app use and completed learning units also count.
3 Processing of your data / legal bases / storage
We process your personal data without your separate consent to justify, structure the content and, if necessary, change your contract of use in relation to the app and to use the app, including all the functions associated with it. Any further processing will only take place if you have consented to it.
Your personal data is processed based on legal regulations that permit data processing because:
- The processing is required to provide the app and all functionalities of the app used, i.e. to fulfill the user contract with you in relation to the app (Art. 6 Para. 1 lit. b DSGVO); or
- You have given us your consent (Art. 6 Para. 1 lit. a GDPR).
- The personal data of the person concerned will be deleted or blocked as soon as the purpose of storage no longer applies, but at the latest after 18 months if the app is not used or used. Storage can also take place if this has been provided for by the European or national legislator in EU regulations, laws or other regulations to which the person responsible is subject. The data will also be blocked or deleted if a storage period prescribed by the standards mentioned expires, unless there is a need for further storage of the data for the conclusion or fulfillment of a contract.
This data protection declaration informs you about the type, scope and purpose of the processing of your personal data when using the app, including all associated functions in accordance with the user agreement with you.
3.1 Registration and Login
To complete certifications in the app, collect points, use the webinar function and seminar management, you must log in. You must enter the following data to log in:
- your first and last name
- Your email address
- your personal password
Otherwise, we will delete or anonymize the user account including the name, e-mail address and password immediately, but no later than after 18 months, as soon as they are no longer required for the aforementioned purposes.
The legal basis for the processing of the aforementioned personal data is the user contract for the use of the app (Art. 6 Para. 1 lit. b GDPR).
3.2 Use of the App/Usage Data
As soon as you open the app, we process certain usage data automatically. This includes both the IP address assigned to your end device and information about the use of the app, e.g. date and time as well as the language of the app usage.
This data processing takes place in order to enable the use of the app. In addition, we keep this information for the purpose of identifying and tracking misuse, to the extent that this is necessary to ensure efficient detection, detection and tracking of incidents of misuse. Processing for other purposes does not take place. Our legitimate interest in this processing is to ensure the security and functionality of the service and its proper use.
User data such as B. the IP address and movement steps in the app will be deleted immediately.

3.3 Use of app functionalities/content data
We process the data that you enter when using the app and the functions associated with it or that arise in the process. The functions result from the current version of the terms of use. The following data processing takes place within the framework of the currently available functions:
3.3.1 Completion of Certifications
The app allows you to complete certifications.
The certification process cannot be interrupted for a successful certification.
The information required to create the certificate includes the first name and last name of the user.
3.3.2 Points account (only for partner agencies)
The points account assigns points to a course. As soon as this has been worked through completely (condition: view the content by learning path) or a certificate has been created, the user receives a credit in his profile.
The points account is only activated for partner agencies (specialist advice).
In order to issue services, the following information is required:

3.3.3 Webinars
Philips also offers an easier access to internal webinars via the app (Join.me interface). No new registration is required for this.
However, it is still possible to participate in the webinars directly via the external APP or website of "Join.me".
3.3.4 Seminar tool
The user of the APP can register for and cancel product and sales seminars.
For this purpose, only the first name and surname are recorded for the creation of the certificate of participation.
3.3.5. Feedback & Comment
The feedback module makes it possible to rate provided content by awarding stars. It also contains a comment function that can be accessed directly from the content and allows comments to be sent. Comments will be emailed to Philips. The data is only used for analysis purposes.
4 Authorizations of the app to access functions and data on the end device
In order to be able to use all the functions of the app, you must grant the app permissions to access the functions and data of your end device. In detail, the following access is required for the purposes mentioned:
INTERNET: Allows access to the Internet to download the learning content
ACCESS_NETWORK_STATE: Allows to check if there is an internet connection
We will only use the permissions granted for the aforementioned purposes. You can normally revoke a granted authorization at any time in the settings of your device (however, this depends on the respective end device and the operating system, over which Philips has no influence.
5 Sharing of Data
Within Philips Domestic Appliances Australia, only those departments that need access to your data to protect our legitimate interests or to fulfill our contractual and legal obligations will have access to them.
Your personal data will only be passed on to third parties without your consent in addition to the other cases mentioned in this data protection declaration in the following cases:
If it serves to clarify illegal app use or is necessary for legal prosecution, personal data can be forwarded to the law enforcement authorities and, if necessary, to injured third parties. However, this only happens if there are concrete indications of illegal or abusive behavior. A transfer can also take place if this serves to enforce terms of use or other agreements. We are also legally obliged to provide information to certain public bodies upon request. These are criminal prosecution authorities, authorities that prosecute administrative offenses subject to fines and the financial authorities.
Occasionally we are dependent on contractually affiliated third-party companies and external service providers to provide our service, for example for our customer service or the hosting of our websites and apps. In such cases, information is passed on to these companies or individuals in order to enable them to process it further. These external service providers are carefully selected by us and checked for compliance with the contractual specifications. External service providers may only process the data for the purposes specified by us and in accordance with our instructions.
6 Your rights as a data subject
What rights do you have in connection with the processing of this data?
You have the right to request confirmation at any time as to whether we are processing personal data and the right to information about this personal data.
In addition, you have the right to correction, deletion and restriction of data processing, as well as the right to object to the processing of personal data at any time, or to revoke your consent to data processing at any time or to request data transfer. In addition, you have the right to complain to a supervisory authority in the event of data protection violations.

7 Changes to this Privacy Notice
We always keep this data protection declaration up to date. We therefore reserve the right to change it from time to time and to update changes in the processing of your data. The current version of the data protection declaration can always be called up under the heading "Privacy Notice" within the app.
